It is prohibited for a business to canvas a consumer registered on this list by telephone, except in the event of contractual relations.

SETTLEMENT OF CONSUMER DISPUTES

In accordance with Articles L611-1 et seq. and R612-1 et seq. of the French Consumer Code, any so-called consumer disagreement or dispute with RESIDE ETUDES SENIORS, subject to Article L.612-2 of the same Code, may be settled amicably by mediation with the CMAP (Centre de Médiation et d'Arbitrage de Paris). The mediator cannot examine disputes for which the request is clearly unfounded or abusive, or has been previously examined or is currently being examined by another mediator or by a court, or if the consumer has filed his request with the mediator more than one year after his written claim to the lessor or if the dispute does not fall within the mediator’s area of expertise, or lastly if the tenant does not provide proof of having attempted beforehand to settle the dispute directly with the lessor in accordance with the following procedures:

  • 1st sending of the claim by registered letter with acknowledgement of receipt to your residence’s management centre (postal address indicated on your payment notices) or email to mediationsenior@reside-etudes.fr
  • 2nd sending of the claim by registered letter with acknowledgement of receipt to Groupe RĂ©side-Etudes - MĂ©diation Locataire – 42 avenue George V – 75008 PARIS, if the dispute is not settled within two weeks of the receipt of the first letter.
If no satisfactory reply is received within one month of the second letter, you may submit your dispute to the mediator by whichever of the following methods you choose:
  • Filling in the form on the CMAP website: http://www.cmap.fr/ “You are a consumer” tab.
  • Sending your request by ordinary or registered letter to CMAP MĂ©diation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS.
  • Sending an email to consommation@cmap.fr
Whatever the means used to refer the matter to the CMAP, the request must contain the following elements in order to be processed quickly: the postal, email and telephone contact details and the names and addresses of the parties to the disputes; a brief presentation of the facts; a copy of the two written claims prior to the referral of the matter to the CMAP
